Before I mention them, this is a constant talking point of the republicans where it benefits the rich corporations (mostly the hospitals but the doctors are incorporated and enjoy the benefits of large corporations) and can leave a true victim of malpractice with absolutely nothing.  
Now for the reasons.  First off, medical malpractice premiums are a problem but not the real cause and not that big a problem.  If you have an HMO, PPO, etc, there is already a stipulation in your insurance contract that disputes are to be referred to a arbitration board whose decision is final (no lawsuits).  As I said that it is a problem but the problem is that the insurance companies are overcharging for it, the way to control that is to control the amount the insurance companies can charge (for the average doctor) to a certain percentage above what they have to pay out (cost plus).  
Secondly, it is true that a doctor that is prone to mistakes that his premium rates will go up and the government should not be required to pay for that.  It does have a speck of good where an error prone doctor could be priced out of business unless he cleans up his act.  A doctor or anyone else should never get off scot free for his mistakes.</description>
